House Passes Anti-Fraud Bill Raising Concerns for Medicaid HCBS Spending

H.R. 8464 passed the House, allowing agencies to delay federal payments flagged as fraud risks — raising concerns it could target legitimate Medicaid HCBS spending increases.

The House passed H.R. 8464, the Stopping Fraudulent Payments Act, on June 10. The bill allows federal agencies to temporarily delay or condition disbursements flagged as presenting elevated fraud risk based on anomalous payment patterns, including increases in payment volume.

LeadingAge is concerned that legitimate increases in Medicaid Home and Community Based Services (HCBS) spending — driven by beneficiary preference for community living over institutional care — could trigger fraud flags under this standard. The bill includes notice and contest procedures, but payment release ultimately depends on agency determination. LeadingAge will continue monitoring the bill as it moves to the Senate.
