In a significant regulatory win advocated by LeadingAge for hospices, the Centers for Medicare and Medicaid Services announced they will be exercising enforcement discretion regarding hospice compliance with the newly required hospice election statement addendum that will be required for each hospice enrollee starting October 1, 2026.

The agency’s move, a welcome approach for providers concerned by having limited guidance on how to adhere to the new addendum requirement, which must be completed for every patient starting October 1, 2026, follows a meeting between LeadingAge and CMS staff two days prior that included discussion of and advocacy for this enforcement discretion.
